I’m committed to making all of my coaching programs, courses, and resources as valuable as possible. That said, it’s important to be clear: I cannot (and no one should) guarantee specific results such as weight loss or health improvements. I’m not a doctor or mental health provider, and while my goal is to guide and support you with science-backed, proven strategies, your results will ultimately depend on your own body, circumstances, and commitment.

Your voluntary participation in these programs specifically acknowledges that you are solely responsible for your own results, health and happiness. These programs have not been evaluated by the Food & Drug Administration and are not intended to diagnose, treat, cure or prevent any disease. Do not rely upon any information found in these programs to determine dietary changes, a medical diagnosis or course of treatment. Take your health seriously, perform your own research and make decisions with your own licensed health care providers. You must obtain clearance from your doctor before beginning any exercise program.

Your voluntary participation in these programs specifically absolves Mindy Garrett and Mind & Body Elite, LLC of any and all liability related to the information provided here.

By purchasing or participating in any of our programs, you expressly agree that you are solely responsible for your own results, health and happiness. We offer no representations, warranties or guarantees verbally or in writing regarding results of any kind.

These programs have not been evaluated by the Food & Drug Administration and are not intended to diagnose, treat, cure or prevent any disease. These programs are provided for informational, educational, and inspirational purposes only.

PAYMENT TERMS AND CONDITIONS

Coach Mindy / Mindy Garrett and Mind & Body Elite, LLC does not offer refunds on digital products, downloadable program services, online courses or any other online coaching materials. All sales are final and there are no refunds after purchase, unless otherwise stated below.

All purchases are final and non-refundable unless otherwise stated below.

Please do not enroll in one or our online programs if you simply want to check it out. We went all in when creating each of our courses, programs and memberships, and expect you to do the same.

Due to the digital nature of our programs, courses, and resources, all sales are final and non-refundable. Once a course or resource is purchased and delivered, you have immediate access to all content within, and we are unable to offer refunds, exchanges, or cancellations.

Private Coaching upgrades for any of Coach Mindy / Mindy Garrett / Mind & Body Elite, LLC coaching programs, courses, and resources are non-refundable.

There are no refunds for unused or expired coaching sessions - no exceptions.

All Private Coaching sessions that are included in a month-to-month program must be used within the month they are billed. Any unused sessions will not automatically carry over to the following month and there are no refunds for any unused sessions.

Program, Course, and Resource Confidentiality

Once you gain access to the program, course, and/or resource, it is extremely important to note that you cannot post screenshots or screen recordings of modules/phases/lessons/trainings/materials, or share passwords to the membership site, via social media, or share it with anyone else in any way. If violated, your access will be terminated without a refund.

Return Policy / Refunds

Due due to the downloadable nature of the content immediately available to you inside our coaching programs, courses, and resources, there are no refunds, cancellations, or exchanges. All sales are final.

For monthly billing programs, you may cancel your program at anytime by submitting your request in writing to Coach Mindy / Mindy Garrett at mindy@mindandbodyelite.com. NOTE: all requests are to be submitted in writing at least 5 days prior to your next scheduled billing cycle. Reoccurring payments will be processed until your request is sent in and any payment(s) processed until such notice is provided are not refundable.

Online Program Payments

Program options for services may include the following:

Full Payment Plan:1 payment in full due upon purchase.
Split Payment Plan: 2 equal payments, first payment due upon purchase with 1 equal payment in 30 days.
Three Payment Plan: 3 equal monthly payments, first payment due upon purchase with 2 equal payments every 30 days.
Six Payment Plan: 6 equal monthly payments, first payment due upon purchase with 5 equal payments every 30 days.

Note: if a payment fails or is declined, we will automatically process the charge a second time and contact you should the final attempt fail.

If payment for services has not been received within 72 hours of contact, we reserve the right to temporarily remove you from the program and access to any associated materials and communities until payment is received.

You are responsible for the full payment amount of your program, course and/or resource regardless of your participation level.

Monthly Programs & Coaching Subscriptions

‍When you register for one of our monthly programs or subscribe to a monthly coaching program, you acknowledge and agree that Mind & Body Elite, LLC or its third party payment processor is automatically authorized to charge you for your monthly, quarterly or annual subscription plan, for as long as your subscription plan remains active. Your subscription is continuous and your payment plan will continue until you cancel it by submitting your request in writing or Coach Mindy / Mindy Garrett / Mind & Body Elite, LLC suspends or cancels your program or service. Note: your plan price may change at the end of your current subscription period if created with a promotional rate.

To cancel your program or subscription, you must submit your request in writing at least 5 days prior to your next billing cycle:

Submit your notice of cancellation in writing to Coach Mindy at mindy@mindandbodyelite.com at least 5 days prior to your next scheduled payment.
All cancellations requested within 5 days of scheduled payment will be subject to full remittance of payment. No exceptions.

Pricing‍

Once you purchase a monthly program or subscription, the initial price you purchased will remain the same so long as you maintain an active program or subscription. Note: should you choose to cancel your program or subscription and re-purchase services at a later date, your monthly fee will be subject to current program and/or subscription rates.

Monthly Program & Subscription Dues

Monthly program and subscription options may be purchased as monthly, quarterly, or annually, with payment collected as follows:

Monthly: 1 monthly payment due at the time of purchase with each monthly payment thereafter collected on the same date of the month(s), or
Quarterly: 1 quarterly payment due in full at the time of purchase with each quarter payment thereafter collected on the same date of the month(s) of the original purchase date, or
Annually: 1 annual payment due in full at the time of purchase with each annual payment thereafter collected on the same date of the original purchase date

You are responsible for the full payment amount of your program, course and/or resource regardless of your participation level.

Note: if you do not download the content purchased and/or resources provided during the time of your active monthly program and/or subscription, you will no longer have access to the content and/or resources upon removal.

Intellectual Property

Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works of, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the content, recordings, methods or other materials related to this course/membership.

Release Authorization

By enrolling in Mind & Body Elite's programs, including but not limited to, The Healthy Habits Game Plan, Online Fitness Club, The Weight Loss Solution, and Eat, Treat, Repeat, you hereby release all of your rights, and grant to Mind & Body Elite, LLC at www.mindandbodyelite.com (Coach Mindy / Mindy Garrett), the right to use your image, in video or still photograph, and to use the likeness and sound of your voice as recorded on audio or video tape, and to use any social media posts you voluntarily share inside The Healthy Habits Club, Healthy Habits Game Plan, or Happy Healthy Holidays Facebook groups without limitation, payment, royalty or any other consideration. You understand that your image, audio, or posts may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein your image, sound, likeness, or posts appear. There is no limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. Additionally, you waive any rights to royalties or other compensation arising or related to the use of your image, posts or recording.

Photographic, audio or video recordings, as well as Facebook group posts may be used for ANY USE which may include but is not limited to: Presentations, Courses, Online / Internet videos, Media, News or Press, Promotions or Online Advertising.

You acknowledge that you have completely read and fully understand the above release and agree to be bound thereby. By purchasing this course, you hereby release any and all claims against any person or organization utilizing this material for educational or promotional purposes.

Health Insurance / FSA Reimbursement

Some health insurances, HR Departments, Flexible Spending Accounts (FSA's) and Health Savings Accounts (HSA's) honor the Mind & Body Elite programs to be a reimbursable expense. Certain conditions must be met. You may be eligible to receive a full or partial reimbursement.

TO DETERMINE YOUR ELIGIBILITY I RECOMMEND THE FOLLOWING STEPS:

Check with your employer or insurance provider if you are eligible to receive benefits and what steps may be required.
If required, ask your doctor to complete a letter of medical necessity or write a prescription for program services.
Once you enroll and submit payment for an applicable Mind + Body Elite program, you can request a detailed receipt for services, which will be sent to you via email for you to then download and print.
Submit your detailed receipt along with your signed letter of medical necessity and/or prescription to your employer or insurance provider for reimbursement.
For any of our monthly membership programs, you can print your monthly receipts to submit for reimbursement.

Note: Mind & Body Elite, LLC does not accept HSA credit cards, but you can submit your monthly receipts to your employer/provider for reimbursement. Coach Mindy and/or Mind & Body Elite, LLC cannot provide and/or guarantee eligibility and/or reimbursement of benefits.
