While our online courses, memberships, and coaching programs are ahhhmazing, I do want to be clear that I cannot guarantee you will lose weight. And frankly, no program should. I’m not a doctor, mental health care provider or miracle worker. While I am sure you realize this, it is important to dot all the i’s and cross all the t’s.

PAYMENT TERMS AND CONDITIONS

Mindy Garrett and Mind & Body Elite, LLC does not offer refunds on digital products, downloadable program services or any other online coaching materials. All purchases are non-refundable unless otherwise stated.

REFUND POLICY

There are no refunds after you purchase. Upon purchase, you will have immediate access to the exclusive content I’ve shared with my clients for years as a Health & Fitness Coach. Due to the downloadable nature of the content inside our memberships, refunds will not be issued under any circumstances.

MONTHLY MEMBERSHIPS

PRICING

‍Once you purchase a subscription, the initial price you purchased at will remain the same even if the price increases after your initial purchase. However, if you cancel your subscription at any time and re-subscribe at a later date, your new subscription will be purchased at the most current rate. In other words, your initial purchase price will be honored as long as you do not cancel your subscription after your initial purchase.

MONTH-TO-MONTH PAYING MEMBERS

‍When you register for an Online Fitness Club membership or The Weight Loss Winner membership you acknowledge and agree that Mind & Body Elite, LLC or its third party payment processor is automatically authorized to charge you for your monthly, quarterly or annual subscription plan, for as long as your subscription plan continues. Your subscription is continuous and your plan will continue until you cancel it or we suspend or cancel your account. Your plan price may change at the end of your subscription period if created with a promotional rate.

To cancel your membership, you must submit your request in writing with fourteen days notice:

You must submit your notice of cancellation in writing to mindy@mindandbodyelite.com fourteen days prior to your next scheduled payment.
All cancellations requested within fourteen days of scheduled membership payment will be subject to full remittance of payment. NO EXCEPTIONS!

The VIP Private Coaching upgrade for any of Mind & Body Elite's membership programs is non-refundable and any unused coaching benefits will not carry over.

MEMBERSHIP DUES

Dues are collected monthly, quarterly or annually as:

1 monthly payment due at the time of purchase with each monthly payment thereafter collected on the same date of the month(s), or
1 quarterly payment due in full at the time of purchase with each quarter payment thereafter collected on the same date of the month(s) of the original purchase date, or
1 annual payment due in full at the time of purchase with each annual payment thereafter collected on the same date of the original purchase date

If a payment fails or is declined, we will automatically process the charge a second time and contact you if the final attempt fails.

If payment has not been received within 72 hours of contact, we reserve the right to temporarily remove you from the membership site and associated communities until funds are received.

You are responsible for the full amount of the program regardless of your participation level.

All sales of digital products downloadable upon confirmation of purchase are final, including limited-time 30-day premium content, unless otherwise stated in a guarantee.

‍Month-to-month subscriptions:

‍Subscriptions created will not automatically cancel. For the Online Fitness Club you may cancel your monthly membership at any time after the first full month of your subscription, by emailing Coach Mindy directly at at mindy@mindandbodyelite.com and following the instructions you receive.

For The Weight Loss Winners membership you may cancel your membership at any time after your initial subscription, by emailing Coach Mindy directly at mindy@mindandbodyelite.com and following the instructions you receive. Please note, you will need to provide 14 days notice prior to your next scheduled payment. Payments for the next billing cycle will not be refunded, so please make sure to notify Coach Mindy 14 days before your downloadable content is scheduled to be delivered.

‍Annual subscriptions:

Subscriptions created will not automatically cancel. If you would like to cancel an annual subscription, you may do so at any time. Please note, however, that you need to cancel at least fourteen days prior to your annual renewal date to prevent the next year’s subscription from being processed and billed. There is no trial period and we do not allow cancellations and/or refunds for annual subscriptions; because of this, we recommend you try a month-to-month subscription before purchasing an annual subscription. You may upgrade to an annual subscription at any time.

Upon cancellation of a subscription members will only continue to have access to all Content purchased through the end of the month in which you cancelled, this includes access to the private member's-only Communities (i.e., Facebook Groups or membership site communities), virtual classes, group coaching calls, or Q&A's. Upon cancellation of a subscription quarterly and annual members will continue to receive Content purchased for the quarter or 12-month period originally paid for, and once the quarter or12-month term ends, you will no longer have access to training videos, online content, community support, and/or any coaching services, etc. purchased. We recommend members download all Content purchased during your subscription to a personal device.

‍Please note, if you do not download the Content purchased, you will no longer have access to the Content.

PROMOTIONS AND BONUS MATERIALS

‍Subscriptions created during a bonus will not automatically cancel after the promotional period. All sales are final when purchasing during a promotion. Subscriptions purchased during promotions and bonuses are non-refundable.

INTELLECTUAL PROPERTY

Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works of, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the content, recordings, methods or other materials related to this course/membership.

RELEASE AUTHORIZATION

By enrolling in Mind & Body Elite's programs, including but not limited to, The Healthy Habits Game Plan, The Weight Loss Solution, The Online Fitness Club, The Weight Loss Winners, and Eat, Treat, Repeat, you hereby release all of your rights, and grant to Mind & Body Elite, LLC at www.mindandbodyelite.com (and Mindy Garrett), the right to use your image, in video or still photograph, and to use the likeness and sound of your voice as recorded on audio or video tape, and to use any social media posts you voluntarily share inside The Healthy Habits Club, Healthy Habits Game Plan, or Happy Healthy Holidays Facebook groups without limitation, payment, royalty or any other consideration. You understand that your image, audio, or posts may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein your image, sound, likeness, or posts appear. There is no limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. Additionally, you waive any rights to royalties or other compensation arising or related to the use of your image, posts or recording.

Photographic, audio or video recordings, as well as Facebook group posts may be used for ANY USE which may include but is not limited to: Presentations, Courses, Online / Internet videos, Media, News or Press, Promotions or Online Advertising.

You acknowledge that you have completely read and fully understand the above release and agree to be bound thereby. By purchasing this course, you hereby release any and all claims against any person or organization utilizing this material for educational or promotional purposes.

HEALTH INSURANCE/FSA REIMBURSEMENT

Some health insurances, HR Departments, Flexible Spending Accounts (FSA's) and Health Savings Accounts (HSA's) honor the Mind & Body Elite programs to be a reimbursable expense. Certain conditions must be met. You may be eligible to receive a full or partial reimbursement.

TO DETERMINE YOUR ELIGIBILITY I RECOMMEND THE FOLLOWING STEPS:

Check with your employer or insurance provider if you are eligible to receive benefits and what steps may be required.
If required, ask your doctor to complete a letter of medical necessity or write a prescription for program services.
Once you enroll and submit payment for an applicable Mind + Body Elite program, you can request a detailed receipt for services, which will be sent to you via email for you to then download and print.
Submit your detailed receipt along with your signed letter of medical necessity and/or prescription to your employer or insurance provider for reimbursement.
For any of our monthly membership programs, you can print your monthly receipts to submit for reimbursement.

Note: Mind & Body Elite, LLC does not accept HSA credit cards, but you can submit your monthly receipts to your employer/provider for reimbursement. Coach Mindy and/or Mind & Body Elite, LLC cannot provide and/or guarantee eligibility and/or reimbursement of benefits.
